EXEMPTION FROM SECTION 803.02 OF THE CANADIAN AVIATION REGULATIONS

Pursuant to subsection 5.9(2) of the Aeronautics Act, and after having taken into account that the exemption is both in the public interest and is not likely to adversely affect aviation safety, I hereby exempt GE Aviation Flight Efficiency Services, 20415 72nd Avenue South, Suite 300 Kent, WA 98032 USA, from the requirements set out in section 803.02 of the Canadian Aviation Regulations (CARs), subject to the conditions set out below.
Section 803.02 of the CARs stipulates that no person shall publish or submit for publishing in the Canada Air Pilot an instrument procedure unless the procedure has been developed:

(a) in accordance with the standards and criteria specified in the manual entitled Criteria for the Development of Instrument Procedures; and

(b) by a person who has successfully completed training in the interpretation and application of the standards and criteria specified in the manual entitled Criteria for the Development of Instrument Procedures, which training has been accepted by the Minister.

INTERPRETATION

For the purpose of this exemption:

“Canada Air Pilot” means an aeronautical information publication that contains information on instrument procedures and that is published under the authority of the Minister, and includes the Restricted Canada Air Pilot (RCAP).

PURPOSE

The purpose of this exemption is to authorize GE Aviation Flight Efficiency Servicesto develop, publish or submit for publishing, in the Canada Air Pilot, an instrument procedure intended for WestJet use only which has been developed in accordance with the instrument procedure criteria set out in the GE Aviation Flight Efficiency Services  Volume A4A – Design Criteria Manual,  the GE Aviation Flight Efficiency Services  Volume A4B.03 – DCM Regulatory Supplement - Transport Canada, and the GE Aviation  Flight Efficiency Services Volume A4C.03 - Regulatory Compliance Supplement - Transport Canada or revised versions of either manual which have been approved by the Minister.

APPLICATION

This exemption applies to GE Aviation Flight Efficiency Servicesfor the development, publication or submission for publication in the Canada Air Pilot of the following instrument procedures:

a) Required Navigation Performance Area Navigation (RNP RNAV) Instrument Approach Procedure for use by WestJet with their Boeing 737 NG aeroplanes, or

b) Required Navigation Performance Area Navigation (RNP RNAV) Instrument Departure Procedure for use by WestJet with their Boeing 737 NG aeroplanes.

CONDITIONS

This exemption is subject to the following conditions.

  1. RNP RNAV Instrument Approach or Departure Procedure, as the case may be, must be designed in accordance with the GE Aviation Flight Efficiency Services Volume A4A - Design Criteria Manual, Issue 5 Rev 0, the GE Aviation Flight Efficiency Services Volume A4B. 03 - DCM Regulatory Supplement -Transport Canada, Issue 5 Rev 2 and the GE Aviation Flight Efficiency Services Volume A4C.03 - Regulatory Compliance Supplement - Transport Canada, Issue 3 Rev 2.

  2. In the event that GE Aviation Flight Efficiency Services is considering making an amendment to either manual referred to in condition 1, GE Aviation Flight Efficiency Services shall obtain TC approval of the amendment prior to developing, submitting for publication or publishing a RNP RNAV procedure.

  3. Certified Flight Path Designers or Flight Path Designer in Training, under direct supervision of a Certified Flight Path Designer who is authorized to supervise, shall develop the RNP RNAV procedures.

  4. The minimum qualifications and training for Certified Flight Path Designers must be done in accordance with the GE Aviation Flight Efficiency Services Volume A2 – Quality Manual, Issue 15 Rev 0, the GE Aviation Flight Efficiency Services Volume A5 - Training Manual, Issue 6 Rev 2 and the GE Aviation Flight Efficiency Services Volume A5A - Operations Technical Training Structure, Issue 5 Rev 0.

  5. In the event that GE Aviation Flight Efficiency Services is considering making an amendment to the manuals referred to in condition 4, GE Aviation Flight Efficiency Services shall obtain TC approval of the amendment prior to developing, submitting for publication or publishing a RNP RNAV procedure.

  6. The instrument procedure, after being developed by a Certified Flight Path Designer, must be reviewed and approved by the Chief Design Engineer or the Deputy Chief Design Engineer before it is submitted for publication.

CANCELLATION

The exemption from section 803.02 of the Canadian Aviation Regulations issued on January 23, 2014, at Ottawa, Ontario, Canada, by the Director General civil aviation on behalf of the Minister of Transport, is hereby cancelled because it is the opinion of the Minister that it is no longer in the public interest or is likely to adversely affect aviation safety.

VALIDITY

This exemption is valid until the earliest of the following:

a) December 31st, 2016 at 23:59 EST;

b) the date on which any of the conditions set out in this exemption is breached; or

c) the date on which the Minister cancels this exemption, in writing, where she is of the opinion that it is no longer in the public interest or that it is likely to adversely affect aviation safety.
